Terms of Service

1. Overview
Home Appliance Care LLC (“Home Appliance Care,” “we,” “us,” or “our”) provides repair services for residential dryers, washers, garbage disposals, refrigerators, and stoves/ovens within a 20-mile service radius of 22079 (Lorton, VA), as well as any other services described on our website from time to time (collectively, the “Services”). By scheduling a service appointment, creating an account, or otherwise using our website or Services, you agree to be bound by these Terms of Service (the “Terms”). If you do not agree to these Terms, you must not use the Services.
These Terms form a binding agreement between you (“you” or “Customer”) and Home Appliance Care LLC.
2. Eligibility
You must be at least 18 years old and able to form a legally binding contract, or have the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf.
By using the Services, you represent that you meet these eligibility requirements and that the information you provide to us is true, accurate, and complete.
3. Scope of Services
- Our Services are limited to diagnosing and repairing residential appliances identified at the time of booking within our 20-mile service radius of 22079 (Lorton, VA).
- Services outside this radius may incur additional travel fees or be declined at our discretion.
- We do not provide structural, plumbing, electrical, or gas-line work beyond what is reasonably incidental to an appliance repair and permitted under applicable law and licensing requirements.
- We also perform installations of new appliances given that they are already placed at their correct place of use.
- We reserve the right to decline or discontinue a repair if, in our reasonable judgment, conditions at the premises are unsafe, unsanitary, or otherwise inappropriate for the work, or if the location exceeds our service radius.
4. Scheduling, Access, and Customer Responsibilities
- You are responsible for providing us with accurate contact information, appliance type/serial/model number (images preferred), and a description of the issue at the time of booking.
- You must ensure that an adult (18+) is present at the service address during the appointment window and that our technician has safe, unobstructed access to the appliance, necessary utilities (water, gas, electricity), and parking.
- If our technician is unable to complete diagnosis or repair due to lack of access, unsafe conditions, or incorrect information, you may still be responsible for any diagnostic or trip fees incurred.
5. Service Fees, Estimates, and Payments
- You will be informed of our diagnostic fee and general pricing structure before or at the time of booking or diagnosis. In some cases, additional charges may apply for after-hours, weekend, or holiday service, or for rural/extended service areas.
- After diagnosis, we will provide an estimate for parts and labor. Estimates are based on information available at the time and may be adjusted if additional issues are discovered during the repair.
- Payment is due upon completion of the service visit, unless we expressly agree in writing to different terms. We may accept cash, major credit/debit cards, and other electronic payment methods as listed on our website.
- When you choose to pay by credit or debit card, a 3.9% payment processing fee is added to the transaction total to cover card processing costs charged by our payment processor and financial institutions. This fee will be disclosed on your invoice at the time of payment.
- If you fail to pay when due, we may charge late fees where permitted by law, suspend further service, and take reasonable steps to collect any unpaid amounts, including referring your account to a collection agency as allowed by applicable law.
6. Cancellations, Rescheduling, and No-Show Fees
- You may cancel or reschedule an appointment by contacting us within 24 hours before the scheduled appointment window.
- We reserve the right to charge a diagnostic fee if our technician arrives and is unable to access the premises or appliance for reasons outside our control.
- We may reschedule or cancel an appointment due to technician illness, emergencies, severe weather, supply chain issues, or other circumstances beyond our reasonable control. In such cases, we will use reasonable efforts to notify you and offer a new appointment.
7. Parts, Warranty, and Limitations
7.1 Parts
We may use new, or manufacturer-approved equivalent parts, depending on availability and your appliance model. If a specific part type (e.g., OEM vs. aftermarket) is important to you, you must request that in writing before we order or install the part and accept any associated cost differences.
7.2 Labor Warranty
For non-warranty repairs, we provide a limited labor warranty for defects in our workmanship for a period of 30 days from the date of the repair. Warranty repairs (e.g., under manufacturer coverage) follow the terms of the original warranty provider.
If a covered issue recurs within the labor warranty period and is determined by us to be caused by our workmanship, we will, at our option, re-perform the labor.
7.3 Parts Warranty
Any warranty on parts is limited to the manufacturer’s warranty, if any. If a part fails due to a manufacturer defect within the warranty period, our responsibility is limited to assisting you in processing a claim with the manufacturer when reasonably possible and, where applicable, reinstalling the replacement part.
Our labor to replace a defective part may be covered or charged depending on the circumstances; this will be stated in your invoice or disclosed at the time of service.
7.4 Warranty Exclusions
The warranties above do not apply to:
- Damage or failure caused by misuse, abuse, neglect, improper maintenance, overloading, power surges, water damage, pest damage, acts of nature, or alterations/repairs performed by you or a third party after our service.
- Pre-existing conditions, hidden defects, or issues not reasonably discoverable during the original diagnosis.
- Cosmetic issues that do not affect the appliance’s basic operation (for example, minor dents, scratches, or discoloration).
Warranties are void if you or a third party (other than us) modify, tamper with, or attempt to repair the appliance in any way that affects the original repair.
8. Refund Policy
- Service fees (including diagnostic and trip charges) are generally non-refundable once the service has been performed, except as expressly provided in these Terms or required by law.
- If you believe the service was incomplete or unsatisfactory, you must notify us in writing within 7–14 days of the service date, describe the issue in reasonable detail, and provide an opportunity for us to inspect and, if appropriate, correct the problem.
- Refunds are considered on a case-by-case basis and may be granted where our review confirms a genuine and verifiable service deficiency that we are unable to cure within a reasonable time.
9. User Content (Reviews, Feedback, and Submissions)
- Any feedback, testimonials, reviews, suggestions, or other content you submit or share with us in connection with the Services (“User Content”) may be used by us for business purposes, including improving the Services and marketing, in any media now known or later developed, subject to any applicable privacy laws.
- You represent and warrant that your User Content is accurate, lawful, and does not infringe third-party rights. We may remove or refuse to display User Content that is offensive, unlawful, misleading, or violates these Terms.
10. Prohibited Uses
You agree not to:
- Use the website or Services for any unlawful purpose or to solicit others to perform or participate in unlawful acts.
- Interfere with or attempt to circumvent the security or proper functioning of our website, systems, or technicians.
- Transmit any malicious code, spam, or harmful content.
We may suspend or terminate access to the Services if we reasonably believe you are engaging in prohibited conduct.
11. Third-Party Links and Tools
- Our website may contain links to third-party websites or provide access to third-party tools. These are provided solely as a convenience. We do not control and are not responsible for their content, policies, or practices.
- Your use of third-party sites or tools is entirely at your own risk and may be subject to terms and privacy policies of those third parties.
12. Personal Information and Privacy
- The collection and use of your personal information in connection with the Services are governed by our Privacy Policy, available at: https://homeappliancecare.us/data-protection-policy/
- By using the Services, you consent to our collection, use, and disclosure of your information as described in the Privacy Policy, and as required or permitted by applicable law.
13. Disclaimers
To the maximum extent permitted by applicable law:
- The Services and our website are provided on an “as is” and “as available” basis, without any express or implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We do not warrant that Services will be uninterrupted, timely, secure, or error-free, or that any particular result will be achieved.
Some jurisdictions do not allow limitations on implied warranties, so the above limitations may not fully apply to you. In that case, the scope and duration of any such warranty will be the minimum permitted under applicable law.
14. Limitation of Liability
To the fullest extent permitted by law:
- Our total liability to you for any and all claims arising out of or relating to the Services or these Terms will not exceed the total amount you actually paid to us for the specific service giving rise to the claim.
- We will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including lost profits, lost data, or business interruption, even if we have been advised of the possibility of such damages.
Nothing in these Terms is intended to exclude or limit liability that cannot be excluded or limited under applicable law (for example, liability for bodily injury caused by our negligence, to the extent such limitation is prohibited by law).
15. Indemnification
You agree, to the extent permitted by law, to indemnify, defend, and hold harmless Home Appliance Care LLC and its members, managers, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your breach of these Terms;
- Your misuse of the Services; or
- Your violation of any law or third-party rights in connection with your use of the Services.
16. Governing Law and Jurisdiction
- These Terms and any dispute or claim (contractual or non-contractual) arising out of or in connection with them or the Services are governed by and construed in accordance with the laws of the Commonwealth of Virginia, without giving effect to conflict-of-law principles.
- For services performed in Maryland, mandatory consumer protections under Maryland law may also apply and cannot be waived where prohibited by law.
- You agree that any legal action or proceeding arising out of or relating to the Services or these Terms will be brought exclusively in the state or federal courts located in Fairfax County, Virginia, and you consent to the personal jurisdiction of such courts, except where applicable law requires suit to be brought in another jurisdiction.
17. Dispute Resolution; Time to Bring Claims
- Before filing any lawsuit, you agree to first provide us written notice of your claim and a brief description of the issue and allow us 30 days to try to resolve it informally.
- Any claim or cause of action you may have arising out of or related to the Services or these Terms must be brought within one (1) year after the claim arose, unless a longer period is required by applicable law.
18. Changes to the Terms
- We may update or modify these Terms from time to time. The “Last Updated” date at the top of this page indicates when changes were last made.
- Changes become effective when posted on our website. Your continued use of the Services after any update constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Services.
19. Miscellaneous
- If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.
- These Terms, together with any service order, confirmation, or invoice, and our Privacy Policy, constitute the entire agreement between you and Home Appliance Care regarding the Services.
- Our failure to enforce any right or provision under these Terms does not constitute a waiver of that right or provision.
